Court Gives Verdict in Three-Year-old Factory Blast Case

A blast in the East Sussex factory of Festival Fireworks UK Limited in December 2006 had killed two people and badly injured around 20 more people. The deceased were fire fighter Geoff Wicker and support officer Brian Wembridge, who were shooting the incident with their camera while the other officers were getting people out of the factory.

The criminal prosecution related to the incident finally was finally settled when Martin Winter, the owner of the factory, was held guilty for manslaughter of the two individuals due to his gross negligence.

The court stated that an unlicensed metal container was being used to store fireworks that were supposed to be exported. Martin Winter was aware that there was a possibility of accident due to the use of unlicensed containers. However, he did not do anything to prevent it. As a result, once a fire started in the factory, it was not possible to stop fireworks from exploding.

The trial was held in front of Lewes Crown Court, which held the company and its owner guilty of violation of health and safety laws. The defendants have argued that the company was not responsible for the death of the victims as the firemen must have been aware of the consequences of getting close to such a fire.

The company run by Martin Winter and his family has been renamed as Alpha Fireworks Ltd. After this verdict, the jury will decide on the two charges of manslaughter against Martin Winter’s son Nathan who runs the company in association with his father.

Study to Be Undertaken on the Level of Worker Safety in the Paper Industry

A recent study has revealed the gross negligence towards workers’ safety in the paper industry in the US that has resulted in fatalities and accidents, and this has led to the UK paper industry to conduct a similar survey on the condition of the health and safety of workers.

According to USW, the union that conducted the survey, the study has revealed that there is widespread dilution of safety and health measures in the paper industry. Not only this, there is compromise on adequate safety training of the staff along with reduction in the number of union safety committees. Apart from this, a new practice of giving financial rewards to the staff as a return for less number of accidents reported has also gained popularity.

Workers Uniting, the first global workers’ union, considers this financial rewards policy a rather cynical development, because this will lead to hiding the flaws in the safety procedures and will discourage investigations of accidents.

Tony Burke, Unite Assistant General Secretary, points out that globalisation is one of the main reasons for this trend of the employers adopting a negligent attitude towards worker safety in the paper industry. John Geenen, USW Vice-President, adds that the problems of worker safety identified in the US paper industry will be found in the UK paper industry also. As an effect of globalisation, the problems will soon be imported from the US to the UK paper industry.

The present campaign taken up by the first truly global union is one of the largest studies related to worker safety and health in the paper industry. PurchasingProperty in Spain: a Description of the Legal Process

Once youve chosen your ideal property and found a Spanish mortgage how do you go about completing the purchase?

The legal process for purchasing property located in Spain falls under two types of transactions. First you have the preliminary contract, or Contrato privado de compraventa, and then you have the completion contract, or Escritura de compraventa.


Once both parties have agreed to the price, then a preliminary private sales contract should be signed. Before the Contrato privado de compraventa is signed, the vendor must show proof of ownership, and also proof that there are no liens or judgements against the property. In Spain, debts are attached to the property, so any mortgage that was outstanding would transfer to the buyer. Nota Simple documents were developed to validate if a property has an outstanding debts.

Details such as completion date, price and description will be written in the first sales contract. When you reach this point, you can expect to pay a deposit of 5-15%. This money shall be held in escrow for your benefit. A person would theoretically be able to sign the initial sales contract without a deposit, but it isn’t necessarily a good idea.


Escritura de compraventa is otherwise known as the second or final contract stage. The customer will need to pay all fees and the price of the product on the date of completion. Next, the seller and buyer meet and sign a contract, which is essentially a claim to the property. Also known in Spain as the escritura, the purchaser will received this deed which is usually in front of a Notary Public. In order for everything to be legal a copy of the deed will have to go through the tax office and property registry. In Spain, Notary Publics are public officials required to witness a deed of sale, but you should also make sure to have your own independent expert legal advice to make sure that your own interests are protected during this legal process. Part of the fees for purchasing include property tax, and legal fees for your Notary Public.

Brake Encourages Corporate Participation in Road Safety Week

This year, road safety charity Brake is hosting the Road Safety Week from November 23 to 29. The focus is on increasing the participation of companies to help drive home the message of ‘No drop, No drag’. Brake feels that drinking and drug-related accidents on the road are a major area of concern and that the message needs wider dissemination, which companies are in a position to do amongst their employees, suppliers, customers and the public at large through their extensive reach.

Companies that wish to participate can choose to highlight this message and help launch new initiatives like corporate driver safety regulations, safety training for drivers and the like, or they may choose to promote their own theme based on its relevance to the company’s values and business philosophy. On May one, 2009, there had been a recall of fourteen Hydroxycut diet-aid products springing from a number of reports that folks using the products were developing significant liver issues and other health worries. Less than 7 days later, on May 4, the 1st Hydroxycut class action court action was filed against the company that manufactures the products, Iovate Medical Sciences. The Hydroxycut Lawsuit alleges company laxity in informing the public about potential risks of the products. Naturally, it’s too soon to know how the suit is going to turn out, but if the company had information which it did not reveal to buyers, it should definitely be held accountable.

A class action lawsuit is filed by a group of folk, all of whom have similar claims against a certain company. Filing a class action is just as effective, and far less pricey, than filing an individual suit. As a rule, filing a class action court action will not cost you anything unless there is a settlement. At that point, the lawyer who handled the suit will take his charges from the compensation that got given and then assign the remaining funds to the plaintiffs in the case. Since this is the case, you will be ready to file a Hydroxycut class action suit without paying a penny out of your own pocket, which is one of the explanations that class action suits became so popular.
